Distance Sales Contract

1. General terms

Hereinafter referred to as the Seller.
1.2. Buyer
Orders may be placed by an individual who is at least 18 years old and has legal capacity.
The Buyer is identified by the first name, surname and contact details provided in the order. The Buyer must provide accurate and complete personal information, an email address, a telephone number and the delivery information necessary to fulfil the order.
Before selling alcoholic beverages and receiving payment, the Seller verifies the Buyer’s identity and age using the electronic identification means prescribed by Section 6¹(4) of the Latvian Law on the Handling of Alcoholic Beverages. The purchase may not be completed and payment may not be accepted without successful verification. This verification does not replace the identity document check when the goods are received.
The Seller hands over the goods only to a person who presents an identity document confirming that they are at least 18 years old. If the document is not presented or the person is under 18, the goods will not be handed over and the order will be cancelled in accordance with Section 6.
The processing of personal data is governed by the Privacy Policy.
1.3. Goods and prices
Product descriptions, composition, volume and alcohol content are provided on each product page.
All prices are stated in euro (EUR), including value added tax. Delivery costs are calculated separately and displayed before the order is confirmed.
Product images in the online store may differ slightly from the actual goods. Please contact the Seller before placing an order if any aspect of the product description is unclear.
1.4. Subject matter of the contract
This distance sales contract is concluded between the Seller and the Buyer for the sale of goods through the online store www.rozewines.com. The contract is concluded remotely and is subject to Latvian Cabinet Regulation No. 255 of 20 May 2014, “Regulations Regarding Distance Contracts”.
The Buyer’s details, the selected goods, their quantities and prices, the payment method, and the delivery method, costs and deadline stated in the order form part of the contract.
Before submitting the order, the Buyer can open links to this distance sales contract and the Privacy Policy next to the acceptance checkbox on the checkout page. By selecting the checkbox, the Buyer confirms that they have read and agree to the distance sales contract and have read the Privacy Policy.
2. Payment terms
2.1. When the contract is concluded
Submitting an order constitutes the Buyer’s offer to purchase the goods.
After the order has been submitted, the Seller sends an acknowledgment of receipt to the email address provided by the Buyer in the order. This acknowledgment does not constitute acceptance of the contract.
The contract is concluded when the Seller emails confirmation of acceptance of the order for fulfilment to the email address provided in the order. This confirmation is sent after successful receipt of payment, provided that the identity and age verification required by Clause 1.2 was completed beforehand. The email or its attachments provide the Buyer, in a form that can be saved, with the version of this distance sales contract in force when the order was placed, the order and delivery information, and the withdrawal form.
If the Seller cannot accept the order, the amount paid will be refunded in full in accordance with Section 6.
2.2. Payment methods
The cashless payment methods available for the particular order are displayed on the checkout page before payment.
- Online banking payment: Citadele, Swedbank, SEB, Luminor or Paysera, where the relevant bank is offered at checkout.
- Payment cards, where this payment method is available for the particular order. Accepted card types are displayed at checkout.
- Payment in instalments (Klix Pay Later), where this solution is available for the particular order and the lender approves financing. The platform is provided by AS “Citadele banka”, registration No. 40103303559.
Klix Pay Later is a technological solution bringing together offers from several lenders; Klix itself neither provides credit nor acts as a credit intermediary. The identity of the specific lender and the financing terms are presented to the Buyer before the credit agreement is signed. The credit agreement is a separate agreement between the Buyer and the relevant lender, and the Seller is not a party to it.
Payment is made in euro. The order is released for fulfilment only after payment has been received and the identity and age verification required by Clause 1.2 has been completed.
3. Delivery terms
3.1. Delivery methods, costs and deadlines
Delivery is available only within the Republic of Latvia.
Cross-border delivery outside Latvia, including to Lithuania and Estonia, is not offered. Orders addressed outside Latvia will be cancelled and the amount paid refunded under Section 6.
Only services available for the particular delivery address and capable of meeting the requirements of Clause 3.3 can be selected at checkout. Delivery of alcoholic beverages to parcel lockers is not offered.
UPS Standard — UPS tariff; exact charge at checkout; 5–6 business days after dispatch.
UPS Worldwide Saver — UPS tariff; exact charge at checkout; 1–2 business days after dispatch.
Collection from the store — free of charge; by the deadline shown at checkout; after email notification.
Courier delivery charges are determined according to the selected service’s tariff for the particular order. The exact delivery charge and total amount payable are calculated automatically and displayed to the Buyer at checkout before the order is submitted and payment is made.
The courier delivery periods stated above are estimated transit times starting when the goods are handed over to the carrier. The overall delivery deadline, including order processing and the restrictions in Clause 3.3, is displayed at checkout before the order is submitted and payment is made, and is repeated in the order acceptance confirmation. Business days are Monday to Friday, excluding public holidays in the Republic of Latvia.
Free courier delivery is not offered. Delivery charges are not subject to discounts or promotions based on the order value. Collection from the store is free of charge.
3.2. Collection from the store
Goods may be collected from the store at Kuršu iela 10, Liepāja, LV-3401, Latvia, during opening hours: Monday to Saturday, 10:00–20:00; Sunday, 10:00–18:00.
The deadline by which the order will be ready for collection is displayed at checkout before the order is submitted and payment is made. Once the order is ready, the Seller emails the Buyer a notification stating the earliest permitted collection time. The Buyer should visit the store only after receiving this notification and must observe the restrictions in Clause 3.3.
3.3. Restrictions on the delivery of alcoholic beverages
Alcoholic beverages may be handed over to the Buyer only at the following times: Monday to Saturday, 10:00–20:00; Sunday, 10:00–18:00.
The goods will not be handed over earlier than six hours after the order was placed. Time is calculated according to Latvian local time (Europe/Riga).
Goods are handed over only in person to an adult recipient, after an identity document has been checked to establish the recipient’s identity and confirm that they are at least 18 years old. Goods are not left unattended and are not delivered to parcel lockers.
If the goods cannot be handed over for the reasons set out above, the order will be cancelled in accordance with Section 6.
4. Right of withdrawal
4.1. Withdrawal period
The Buyer has the right to withdraw from the purchase within 14 days without giving any reason.
The period starts on the day the Buyer, or a third party designated by the Buyer other than the carrier, receives the goods. If several goods from one order are delivered separately, the period starts on the day the last item is received.
4.2. How to give notice of withdrawal
To exercise the right of withdrawal, the Buyer must inform the Seller of their decision by an unequivocal statement before the period expires. Use of the attached withdrawal form is not mandatory.

Notice may be submitted in Latvian or English.
The deadline is met if the notice is sent before the 14-day period expires.
The Seller promptly acknowledges receipt of the withdrawal notice by emailing confirmation to the Buyer.
4.3. Returning the goods
The goods must be sent or delivered back to the Seller without undue delay and no later than 14 days after the day the Buyer gave notice of withdrawal. The deadline is met if the goods are sent back before this 14-day period expires.

Goods may be returned by post, by courier or in person at the store.
4.4. Return costs
When exercising the right of withdrawal in respect of goods that conform to the contract, the Buyer bears the direct cost of returning the goods. This rule does not apply to remedying a lack of conformity or exercising other statutory rights under Clause 4.7; the Seller bears the necessary return and shipping costs associated with satisfying a valid claim.
4.5. Buyer’s liability
The Buyer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
4.6. Goods excluded from the right of withdrawal
Under Paragraph 22 of Latvian Cabinet Regulation No. 255 of 20 May 2014, the right of withdrawal does not apply in the following cases, provided that the conditions of the relevant exception are met.
- The price of the goods depends on fluctuations in the financial market which the Seller cannot control and which may occur during the withdrawal period.
- The goods are made to the Buyer’s specifications or are clearly personalised.
- The goods are liable to deteriorate or expire rapidly.
- The Buyer has unsealed goods which cannot be returned for health or hygiene reasons.
- After delivery, the goods have become inseparably mixed with other items due to their nature.
If, after delivery, the Buyer has opened the original seal of a bottle of an alcoholic beverage, the right of withdrawal does not apply where the goods are no longer suitable for return for health or hygiene reasons. Opening only the outer transport packaging does not, in itself, remove the right of withdrawal. These restrictions do not affect the Buyer’s right to make a claim concerning damaged or nonconforming goods, including where the defect is discovered after the bottle is opened.
4.7. Goods that do not conform to the contract
The right of withdrawal does not limit the Buyer’s right to make a claim for lack of conformity of the goods with the contract.
If goods are damaged or have a quality defect, the Buyer may contact the Seller irrespective of the 14-day withdrawal period.
The Buyer may make a claim for lack of conformity within two years of receiving the goods, in accordance with the Latvian Consumer Rights Protection Law. Wine may be brought to the store at Kuršu iela 10, Liepāja, LV-3401, Latvia, for a quality assessment by the Seller’s sommelier.
5. Refunds
5.1. Refund deadline
The Seller refunds payments made by the Buyer without undue delay and no later than 14 days after receiving the withdrawal notice, subject to the provisions of this section.
The Seller may withhold reimbursement until the goods have been received back or the Buyer has supplied evidence of having sent them back, whichever occurs first.
5.2. Amount to be refunded
The refund includes the price of the goods and the cost of the least expensive standard delivery option offered by the Seller.
If the Buyer selected a delivery method more expensive than the Seller’s least expensive standard option, the additional delivery costs will not be refunded.
When the right of withdrawal is exercised, the direct return costs borne by the Buyer are not reimbursed, subject to Clause 4.4. This does not limit rights relating to goods that do not conform to the contract.
5.3. Refund method
The refund is made using the same means of payment as the original transaction, unless the Buyer has expressly agreed to another method. No additional fee is charged to the Buyer for the refund.
After the refund has actually been made, the Seller sends confirmation to the Buyer’s email address.
6. Order cancellation
6.1. Cancellation by the Buyer
The Buyer may cancel an order before it is dispatched by contacting the Seller at winesroze@gmail.com or on +371 26 613 165.
If the order has already been dispatched, the withdrawal provisions in Section 4 apply.
6.2. Cancellation by the Seller
The Seller may cancel an order if:
- the goods are out of stock;
- payment has not been received or has been declined;
- the Buyer’s identity or age cannot be verified, the Buyer or recipient has not presented an identity document, or the Buyer or recipient is under 18;
- the delivery address is outside the territory of the Republic of Latvia;
- there is an obvious error in the price or product description in the order.
The Seller promptly informs the Buyer by email of the cancellation and its reason.
6.3. Refunds following cancellation
If an order is cancelled under this section, all payments received by the Seller will be refunded in full without undue delay and no later than 14 days from the date of cancellation. The refund is made using the same means of payment, unless the Buyer has expressly agreed to another method. No additional fee is charged for the refund; the Seller emails confirmation to the Buyer after the refund has actually been made.

7. Dispute resolution
7.1. Contacting the Seller
The Buyer should first submit any complaint to the Seller:

The Seller examines the complaint and responds within 15 business days.
7.2. Consumer Rights Protection Centre

7.4. Applicable law
This contract is governed by the laws and regulations of the Republic of Latvia. Disputes not resolved through negotiation are decided by a court of the Republic of Latvia.
7.5. Contract language
The contract is available in Latvian, English, German and Russian. In the event of differences in interpretation, the Latvian version prevails.
